A Bitter Family Dispute in Court
A bitter feud within the prominent Kirk family has spilled into the High Court. Elizabeth Bertha Tammy Kirk, daughter of incapacitated businessman Thomas Moore Carl Kirk, urgently seeks judicial intervention to secure funding for her studies in the Netherlands. Elizabeth, 23, argues that Robert Kirk and other trustees of the Quadro Trust are unlawfully withholding tuition fees due to her under the trust deed.

Unless the court orders immediate payment, she faces deregistration from her master’s degree programme at Stenden University of Applied Sciences in the Netherlands and possible deportation.
Elizabeth’s Legal Battle
The case, which was before Judge Justice Mavuso yesterday, according to court documents, lays bare years of simmering tension, mistrust, and accusations of abuse of power among the Kirk siblings, now threatening the youngest daughter’s academic future abroad. Elizabeth, represented by Robinson Bertram attorneys, told the court that her application was a last resort after exhausting attempts to negotiate with Robert Kirk, who controls the trust’s disbursements as co-trustee and curator of her father’s estate.
“I sought to be mindful of the deep family conflict from which this matter arises,” Elizabeth deposed in her affidavit. “I pursued the more peaceful route of negotiations. I have personally and repeatedly pleaded with Robert to release the necessary funds to enable me to further my education.”
She claimed Robert exploited her weaker financial position and delayed responses until her visa situation became dire. Her attorney, Zwelethu Jele, took up her case on a pro bono basis after what she claimed was immense hardship that gravely affected her mental health and overall well-being.
Meetings between Jele and Robert’s attorney, John Henwood, yielded no progress according to Elizabeth. “Robert has remained obstructive and uncooperative,” Elizabeth said, adding that she was left with “no option but to urgently approach the court.”
“I am presently resident in the Netherlands without financial provision for my upkeep or academic obligations. Imminent and inseparable harm confronts me, in that I face deregistration from the university coupled with the cancellation of my Dutch residence permit,” she submitted.
Accusations of Abuse of Power
Elizabeth accuses Robert of weaponising his control of the trust to punish her. “Robert’s continued conduct has inflicted upon me severe financial, emotional, and psychological strain. He has weaponised his control over my tuition, flights, and allowances as a tool of harassment, intimidation, and coercion,” she stated.
She argued that the Quadro Trust, created by her father under Trust Deed No. 18/1999 and amended in 2020, was explicitly structured to fund his children’s education. According to Elizabeth, pursuant to the amendment, she became a duly appointed Trustee and beneficiary of the trust.
“Following my father’s incapacitation, Robert was nominated for appointment to be curator over my father’s estate and affairs. In that capacity, Robert assumed de facto control as founder in my father’s stead, and simultaneously exercises powers as Trustee of the Quadro Trust, and further exercises control over his own personal affairs,” Elizabeth stated.
She submitted that notwithstanding the above, since assuming control as curator, Robert has consistently acted contrary to the powers conferred upon him by the Trust Deed. “He has disregarded and subverted the wishes and directives of my father, choosing instead to conduct himself as though he personally rules and controls my father’s estate and assets as if they were his own. In so doing, Robert has arrogated to himself dictatorial powers over the Trust, contrary to both the law and the expressed will of my father,” Elizabeth stated.
By contrast, Elizabeth says her elder siblings, Robert, Laurelle, and Millicent, continue to enjoy regular financial support and even vehicles through the trust despite being over 50 and married. “It is wholly unreasonable, inequitable, and discriminatory that I, a 23-year-old still building the foundation of my life, should be denied access to the trust,” she argued.
Tom Kirk Still Alive – Family Clarifies
Businessman Thomas ‘Tommy’ Kirk has not died, despite suggestions to the contrary, and his family says a significant portion of his resources is being spent on his medical upkeep. In correspondence seen by this publication, Kirk’s family strongly objected to references to him as the ‘late Mr. Kirk’, stressing that as of August 14, he remains alive though facing health challenges.
“Had Elizabeth and Carleen taken the time to visit their father, they would have been aware that Mr. Kirk is still very much alive and well, considering the health challenges that he is facing,” the letter stated.
Family’s Defense and Financial Constraints
The dispute centres on Kirk’s daughter, Elizabeth Bertha Tammy Kirk, who has taken Robert Kirk and other relatives to court, demanding that her tuition fees at NHL Stenden University in the Netherlands be paid. According to family representatives, however, the funds in Kirk’s personal account are primarily dedicated to his medical needs.
Documents attached to the correspondence reveal that Kirk spends about E50 000 per month on medical care and upkeep. While his personal accounts hold just over a million Emalangeni, the family argues that this money cannot sustain both his healthcare and Elizabeth’s overseas studies, which reportedly cost E600 000 annually.
Robert Kirk maintains that Elizabeth could pursue her Master’s degree more affordably in Southern Africa and insists that she and her sister Carleen take responsibility by involving themselves in the family’s businesses. The family also raised concerns about the sisters’ alleged refusal to become tax compliant, which they claim has inflated Kirk’s tax burden to over E600 000 per year.
